So Angry Right Now

I knew that they would give us trouble. I just knew it. Anytime insurance companies are involved, trouble soon follows.

We were rear-ended by a bob-tail 18-wheeler at a stop light. We were stationary. The driver admitted fault. Now his insurance company (the one he gave the police as his insurance company) say that since he was not hauling a load for them (ie working for them at the time), they may not have to pay out even though the vehicle is insured by their company. Now we're just having to sit and wait for the adjuster to pick his teeth and call us back. Bastards.

I don't know where this leaves us. We will contest, of course, but this has never happened to us. We are just not litigious people.

I will say this - if it comes to going to court, they are going to wish they'd just paid out the $4K to fix the damn car. Because we will sue for court fees and mental anguish as well. This is just not on, and it's not fair.

Trust a company to try and weasel out of responsibility. So if the companys insurance wont pay, what about the drivers? He also has to carry insurance and so he is on the hook. Theres no way around it.

If he wasn't under dispatch for the trucking company, he is supposed to have his own insurance to cover an accident  (at least, most trucking companies require that, but drivers have been known not to carry their required coverage). At any rate, have the adjuster check on that possibility.

Have you tried talking to your own insurance? You may have to file a claim with your own ins and they will work it out with the other party.

(((HUGE HUGS))) to the pair of you. If they are being awkward, threaten to add in loss of earnings/potential earnings, cost of alternative transport, and anything else you can think of if they don't cough up a settlement asap . I hope you can get this sorted.

What?!!! That is awful!!!! Does it not work this way - your insurance pays you to fix your car, then goes after the at fault driver? You should not be dealing with this crap. Poor love - I'm so sorry all of this is going on.
